In one of the fastest trials in a Child Protection Against Sexual Offenses Act (POCSO) case in city court, a 48-year-old man was sentenced to three years in prison on Monday rigorous for exposing her private part to a 13-year-old neighbor when she was playing outside.
The man had previously been acquitted in a sexual assault case against his own daughter in 2018 because she did not support the prosecution case in court.
In the present case, the incident took place in Bhandup on October 11, 2020 and the case was presented to the court in mid-December 2020. The trial lasted a total of two months and 15 days during which the court interviewed five witnesses, including the victim, her mother and a neighbor among police witnesses.
Appearing in court, the 13-year-old victim told court she was playing outside with her friends at 3:15 p.m. on the day the accused pulled down his half-pants and flashed her, offering her rupees . 100 if she comes to him at night. She went home and informed her mother, but her mother did not take it seriously. She came out again and he exposed himself again and this time he held her hand. The girl informed her mother again and this time her mother confronted him and he verbally assaulted her mother. She then called the police and the man fled the moment the police arrived. He was then arrested the same day.
The special judge under the POCSO law MA Baraliya ordered the man to pay a fine of Rs. 10,000 and ordered that the amount be paid to the victim as compensation. The man had applied for leniency from the court, stating that he had to look after six children.
